This privacy notice explains how Confianza Capital collects, uses and protects personal data through this website, in line with the Data Protection Act, 2024 (Act No. 18 of 2024) of Botswana. It covers confianzacapital.com. Information you share with us during an engagement is also covered by the confidentiality terms of that engagement.

Who is responsible for your data

Confianza Capital is the data controller for the personal data described in this notice. Our office is at Units 36 & 37, The Office, Fairgrounds Office Park, Gaborone, Botswana, and our postal address is Private Bag 262, Gaborone.

Our Data Protection Officer is Lebogang Gaetsaloe, Risk & Compliance Manager. You can contact the Data Protection Officer at lebo.g@confianzacapital.com about anything in this notice.

What personal data we collect

Enquiries. Our enquiry form asks for your name, email address and a message, and optionally your phone number, company and the service you are interested in. We also record the date and the page you sent it from.

Direct contact. If you email us or message us on WhatsApp, we receive what you choose to send, together with your email address or phone number.

Website visits. Our hosting provider keeps short-term server logs that include your IP address, browser type and the pages you requested. We use these only to keep the site secure and working. We do not use advertising or analytics tracking on this website.

We collect only what we need to respond to you. Please do not send us sensitive personal data, such as health information, through the website. If an engagement later requires such data, we will explain why and ask for it through a secure channel.

Why we use it and our lawful basis

  • To respond to your enquiry and arrange a meeting, because you have asked us to (your consent, and steps taken at your request before entering into a contract).
  • To prepare a proposal or fee letter if you decide to work with us (steps towards a contract).
  • To keep a record of our correspondence and protect the website against spam and misuse (our legitimate interests, which we balance against your rights).
  • To meet our legal and regulatory obligations, for example record-keeping and anti-money-laundering checks if you become a client (legal obligation).

We do not sell your personal data, use it for marketing without your consent, or make decisions about you based solely on automated processing.

Who we share it with

Enquiries are read only by our own team. We use a small number of service providers (our website host and email provider) who process personal data on our behalf, under our instructions and subject to confidentiality and security obligations. We will not share your data with anyone else unless you agree or the law requires it.

Transfers outside Botswana

Our website and email providers may store data on servers outside Botswana. We transfer personal data outside Botswana only where the Data Protection Act, 2024 allows it: for example, where the receiving country provides adequate protection, where appropriate safeguards such as contractual clauses are in place, or where the transfer is necessary to respond to your request.

Cookies and third-party services

The site uses a small number of cookies that it needs to work, and a consent banner lets you decide whether to allow any others. Our fonts are loaded from Google Fonts, so your browser connects to Google’s servers and shares your IP address with Google when you view a page. Links to WhatsApp and Google Maps take you to those services, which have their own privacy policies.

How long we keep it

We keep personal data only for as long as we need it. Enquiries that do not lead to an engagement are deleted within two years. If you become a client, we keep your records for as long as the engagement and our legal and regulatory obligations require, then delete or anonymise them.

How we protect it

We use appropriate technical and organisational measures to protect personal data, including encrypted connections (HTTPS), restricted access to enquiries and password-protected systems. If a personal data breach occurs, we will notify the Information and Data Protection Commission within 72 hours of becoming aware of it where the Act requires, and inform you without undue delay if the breach is likely to put your rights and freedoms at risk.

Your rights

Under the Data Protection Act, 2024 you have the right to:

  • be informed about how we use your personal data;
  • access the personal data we hold about you and receive a copy;
  • have inaccurate or incomplete data corrected;
  • have your data erased where we no longer have a lawful reason to keep it;
  • restrict or object to our use of your data, including for direct marketing;
  • receive your data in a portable format and have it transferred to another organisation where applicable;
  • not be subject to decisions based solely on automated processing; and
  • withdraw your consent at any time, without affecting processing that took place before you withdrew it.

To exercise any of these rights, email our Data Protection Officer at lebo.g@confianzacapital.com. We may need to confirm your identity before acting on a request. We will respond within the period required by the Act and will not charge a fee for a reasonable request.

Children

This website and our services are intended for businesses and adults. We do not knowingly collect personal data from anyone under 18.

Complaints

If you are unhappy with how we have handled your personal data, please contact us first so that we can try to put it right. You also have the right to lodge a complaint with the Information and Data Protection Commission of Botswana.

Changes to this notice

We may update this notice from time to time, for example when the law or our services change. The date at the top shows when it was last updated.
